
Contradictions in the Rule of Law
President Boakai’s inaugural address in January 2024 pledged to uphold the rule of law and protect citizens’ constitutional rights. However, his administration’s record in this regard paints a starkly different picture. The lack of decisive action to investigate and address these allegations undermines the credibility of his commitment to justice and human rights.

Violation of Tenure Law
One of the most glaring governance issues under President Boakai’s administration has been the alleged violation of the Tenure Law. Several integrity institutions and public officials with constitutionally protected tenures have reportedly been dismissed or replaced without due process. This undermines the independence of institutions designed to act as checks on executive power, contradicting the President’s campaign pledge to safeguard integrity and transparency in government.
Facilitation of Legislative Factionalism
President Boakai’s facilitation of a faction within the House of Representatives seeking the illegal removal of Speaker Koffa has sparked controversy. The Speaker’s attempted removal, spearheaded by 42 lawmakers, has been criticized as unconstitutional and a blatant disregard for the separation of powers. The President’s tacit support for this action, alongside public protests in favor of the Speaker, has contributed to political instability and raised questions about his respect for Liberia’s constitutional framework.
Heavy-Handedness by Security Forces
The administration has faced significant criticism for the Liberia National Police’s (LNP) and National Security Agency’s (NSA) heavy-handed approach to handling dissent. Allegations of suppression of peaceful protests, excessive use of force by police, and attacks on journalists have tarnished the administration’s human rights record. Examples include:
• Suppression of Peaceful Protests: Security forces have been accused of deploying tear gas and water cannons against peaceful demonstrators, including students and civil society groups advocating for constitutional rights.
• Attacks on Journalists: Reports of intimidation, physical assault, and harassment of journalists have raised concerns about press freedom. Notably, the alleged targeting of investigative journalists has been widely condemned by media advocacy groups.
• Torture Allegations: Several citizens have reported instances of torture by the LNP and NSA. These allegations are yet to be thoroughly investigated, leaving victims without recourse to justice.
• Unexplained Civilian Deaths: Cases of unexplained or wrongful deaths involving the LNP remain unresolved, eroding public trust in the administration’s ability to ensure accountability within security agencies.
Recommendations for Governance and Rule of Law
1. Adhere to the Tenure Law: The President must respect the tenure of public officials and refrain from any actions that undermine the independence of constitutional offices.
2. Promote Legislative Independence: The executive branch must desist from interfering in legislative affairs and support constitutional mechanisms for resolving disputes within the House of Representatives.
3. Address Human Rights Abuses: A comprehensive and independent investigation into allegations of police brutality, torture, attacks on journalists, and wrongful civilian deaths is essential. Those found culpable should be held accountable.
4. Strengthen Oversight of Security Agencies: Implement reforms to ensure security forces operate within the bounds of the law, with mechanisms for civilian oversight and accountability.
5. Enhance Transparency: The government must prioritize open dialogue with civil society, the media, and opposition groups to rebuild public trust and demonstrate a commitment to democratic principles.
In summary, while President Boakai’s rhetoric on governance and the rule of law appears aligned with democratic ideals, his administration’s actions in practice have raised serious concerns. Addressing these inconsistencies will be pivotal to restoring public confidence and upholding Liberia’s democratic foundations.
