Liberia: LERC Rejects LIBENERGY Tariff Reconsideration, Delays New Rate to November

Monrovia — The Liberia Electricity Regulatory Commission (LERC) has rejected LIBENERGY’s request to reconsider its July 6, 2026, tariff decision, but has deferred implementation of the approved electricity tariff until November 1.

The Commission said the decision follows a review of LIBENERGY’s formal application for reconsideration, filed after LERC notified customers, stakeholders and the public on August 1 that the utility had challenged the tariff decision.

According to a statement issued by LERC, the Commission reviewed LIBENERGY’s request, supporting submissions, the tariff record and relevant provisions of the Electricity Law of Liberia of 2015.

It concluded that LIBENERGY failed to establish any legal, factual or procedural grounds that would warrant reconsideration of the tariff decision.

LIBENERGY had asked the Commission, among other things, to reinstate its proposed energy charge of US$0.25 per kilowatt-hour, arguing that the approved rate of US$0.22 per kilowatt-hour was not cost-reflective.

The utility also requested, alternatively, that implementation of the approved tariff be postponed.

LERC said the arguments presented in the reconsideration application largely repeated issues that had already been considered during the tariff review process and failed to identify any material error of fact or law.

The Commission therefore rejected the application.

However, LERC said it has exercised its regulatory authority to defer implementation of the approved tariff from August 1 to November 1, 2026.

The postponement will immediately follow the expiration of a four-month compliance period previously granted to LIBENERGY to address deficiencies identified in its service delivery.

LERC emphasized that the delay does not alter or reverse its July tariff determination, nor does it validate LIBENERGY’s claim that the approved US$0.22/kWh rate is not cost-reflective.

Instead, the Commission said the extension is intended to give LIBENERGY additional time to implement corrective measures and demonstrate measurable improvements in the quality, reliability and efficiency of its electricity services.

The Commission said it remains committed to protecting the public interest through transparent, fair and evidence-based regulation.

LERC also said it will continue monitoring LIBENERGY’s compliance with its regulatory obligations and service-improvement commitments to ensure that customers receive safe, reliable and efficient electricity services.

The new tariff is therefore expected to take effect on November 1, 2026, subject to the Commission’s regulatory requirements and LIBENERGY’s compliance with the prescribed corrective measures.
