Monrovia – The Monrovia City Court at the Temple of Justice has summoned an employee of the Ministry of Foreign Affairs assigned at the legal section over allegations of misapplication of entrusted property.
Foday Kiatamba who was cited by the court to initially appear on Wednesday, March 23, 2016 at 11:00 am for a conference will now have to appear at the court on Friday, April 1, 2016 due to the change of date.
The initial letter under the signature of the clerk of the court addressed to Kiatamba reads: “Acting upon the directive of his honor Kennedy Peabody, Stipendiary Magistrate of the Monrovia City Court at the Temple of Justice Building, you are hereby cited for a conference to be held in the Temple of Justice chambers on Wednesday March 23, 2016 at 11; 00 am.”
Other parts of the letter reads: As the conference is geared toward amicably resolving the issue as the court anticipates your presence and fullest cooperation in this regard.”
Now a writ of summon lately issued by the Monrovia City Court says that Kiatamba’s appearance for a conference on Friday, April 1, 2016 at 9:00 am is based on a formal complaint filed against him by Fallah Mathews.
“You are hereby commanded to summons the living body of Foday Kiatamba, defendant to be identified, and caused him to appear before the Stipendary Magistrate of the Monrovia City Court on April 1, 2016 at 9:00 a.m. to answer to the action of misapplication of entrusted property,” said the writ of summon from the Monrovia City Court.
In Matthews’ copy which is in the possession of the FrontPage Africa, it indicated that since June 15, 2015, he (Kiatamba) allegedly received from him (Matthews) the amount of US$100 to prepare an article of incorporation for a church and such document has not been received up to present.
The writ of summon furthered that after defendant Kiatamba allegedly received the amount, out of deception and in violation of Section 15.56 of the New Penal Law of Liberia, he failed and neglected to do the document and also failed to return the money in question.
According to the writ, the defendant did criminally convert the money to his personal use and benefits and that the defendant is hereby ordered to appear on the time and date mentioned to answer to the complaint.
Again, the writ of summon alleged that the act of the defendant Foday Kiatamba being unlawful , wicked, illegal and intentional is in violation of the New Penal Law of the Republic of Liberia section 15.56 which defendant did do and commit.
